2. Subscriptions & Payment

European Noir offers both free and paid subscription tiers, managed through our website at europeannoir.com By subscribing, you acknowledge that you have read and agree to these Terms and Conditions.

2.1 Subscription tiers

Free tier: Access to selected posts and the public archive at no charge.

Paid tier: Full access to all posts, the complete archive, and any subscriber-only content, at the rate published on the subscription page at the time of sign-up.

2.2 Payment

Paid subscriptions are processed via our website, powered by Wix Payments or its nominated payment service providers. No cash payments are accepted. Your subscription begins upon successful payment.

 

Prices are stated on the website and include any applicable taxes. Subscription rates may change; existing subscribers will be given at least 30 days' notice of any price increase before it takes effect.

3. Cancellation & Refunds

3.1 Your right to cancel

You may cancel your paid subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period; you will retain access to paid content until that date.

3.2 EU statutory right of withdrawal

Under Dutch and EU consumer law, you have a right to withdraw from a digital subscription agreement within 14 days of purchase without giving any reason and receive a full refund. The 14-day period begins the day after your subscription payment is processed.

To exercise this right, please send an unambiguous written statement to lloyd@europeannoir.com. You may use the model withdrawal form in Appendix I. Your notice must be sent before the 14-day period expires; if the period ends on a weekend or public holiday, the deadline extends to the next business day.

Please note: if you access paid subscriber content before the 14-day period expires, you explicitly agree that the service has commenced and acknowledge that your right of withdrawal is limited accordingly.

3.3 Refunds

Approved refunds will be issued within 14 days of your cancellation notice, returned to the original payment method. Any international bank or transaction fees associated with the refund will be borne by you.

4. Content & Access

European Noir publishes essays, fiction, criticism, and related editorial content focused on the European crime and noir tradition. The publication schedule is at the editor's discretion; we do not guarantee a fixed number of posts per month.

We reserve the right to modify, archive, or remove content at any time. In the event that the publication ceases entirely, paid subscribers will receive a pro-rata refund for any unused portion of a prepaid annual subscription.

5. Intellectual Property

All original content published in European Noir — including essays, fiction, criticism, and editorial commentary — is the intellectual property of Lloyd Miner or the respective credited contributors. All rights are reserved.

Subscribers may read and share individual posts for personal, non-commercial purposes, provided proper attribution is given and a link to the original is included. Reproduction of substantial portions of any post, or use of content for commercial purposes, requires prior written consent.

Where European Noir references or quotes third-party published works, intellectual property rights to those works remain with their respective authors and rights holders.

6. Privacy & Data

The collection and use of your personal data is governed by our Privacy Policy, set out in full in Section 10 below. By subscribing, you acknowledge that you have read and understood the Privacy Policy.

7. Subscriber Conduct

Paid subscription access is personal and non-transferable. Sharing login credentials or paid content with non-subscribers in a manner that substitutes for a paid subscription is prohibited and may result in account termination without refund.

8. Limitation of Liability

European Noir and Lloyd Miner are not liable for any indirect, incidental, or consequential damages arising from your use of or inability to access the publication. Nothing in these terms limits any statutory rights you may have as a consumer under Dutch or EU law.

9. Governing Law & Dispute Resolution

These Terms and Conditions are governed by Italian law. Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Lecce, Italy, without prejudice to your rights as a consumer under the mandatory laws of your country of residence.

Before initiating formal proceedings, we encourage subscribers to contact us at lloyd@europeannoir.com to seek an amicable resolution. The European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr) is also available to EU consumers as an alternative dispute resolution mechanism.

10. Privacy Policy

This Privacy Policy explains how Lloyd Miner, trading as The Writing Grove and publishing European Noir ("we", "us", "our"), collects, uses, and protects your personal data when you subscribe to or interact with European Noir at lloydminer.com.

This policy complies with the EU General Data Protection Regulation (GDPR) and applicable Dutch data protection law. Lloyd Miner is the data controller for the personal data described in this policy.

10.1 What data we collect

When you subscribe (free or paid), we collect: your name and email address; payment information for paid subscribers (processed and stored by our payment provider, Wix Payments — we do not store card details directly); and your subscription tier and status.

When you visit our website, we may collect standard technical data including IP address, browser type, and pages visited, via Wix's built-in analytics. This data is used in aggregated, anonymised form to understand how the site is used.

10.2 How we use your data

We use your personal data for the following purposes:

  • To deliver the newsletter and any subscriber-only content you have signed up for.

  • To manage your subscription, process payments, and send billing-related communications.

  • To respond to enquiries you send us.

  • To comply with our legal obligations.

We will not use your data for automated decision-making or profiling.

10.3 Legal basis for processing

We process your data on the following legal bases under GDPR:

  • Contract: processing necessary to deliver the subscription service you have signed up for.

  • Legitimate interests: sending the newsletter to free subscribers who have opted in, and conducting basic website analytics.

  • Legal obligation: retaining transaction records as required by tax and accounting law.

10.4 Who we share your data with

We share your data only where necessary to operate the service:

  • Wix (website platform and payment processing): your subscription and payment data is stored and processed on Wix's infrastructure. Wix acts as a data processor on our behalf. See Wix's privacy policy at wix.com/about/privacy for details.

  • Legal authorities: where required by law or a competent authority.

 

We do not sell, rent, or trade your personal data to any third party for marketing purposes.

 

10.5 International transfers

Wix operates infrastructure in various countries, which may include transfers of data outside the European Economic Area. Where such transfers occur, Wix relies on appropriate safeguards including Standard Contractual Clauses approved by the European Commission. Details are available in Wix's privacy documentation.

 

10.6 Data retention

We retain your personal data for as long as your subscription is active, and for a period thereafter as required by law (for example, transaction records are kept for seven years for tax purposes). Where data is no longer needed, we delete or anonymise it.

 

10.7 Your rights

Under GDPR, you have the following rights regarding your personal data:

  • Right of access: you may request a copy of the data we hold about you.

  • Right to rectification: you may ask us to correct inaccurate data.

  • Right to erasure: you may ask us to delete your data, subject to legal retention obligations.

  • Right to restriction: you may ask us to limit how we process your data in certain circumstances.

  • Right to data portability: you may request your data in a structured, machine-readable format.

  • Right to object: you may object to processing based on legitimate interests, including direct marketing.

10.8 Cookies

Our website uses cookies and similar technologies via the Wix platform for essential site functionality and, where you have consented, for analytics. You can manage your cookie preferences via the cookie banner displayed on your first visit, or through your browser settings. Declining non-essential cookies will not affect your ability to subscribe or access content.

 

10.9 Security

We take reasonable technical and organisational measures to protect your personal data against unauthorised access, loss, or disclosure. Payment data is handled exclusively by Wix Payments and is subject to PCI-DSS security standards.

10.10 Changes to this policy
